Terms & Conditions

The following conditions apply to all events organized by Swingin' Pool Cologne e.V.

§1 Gerneral
(1)The Swingin' Pool Cologne e.V. association - hereinafter referred to as the organizer - offers various courses, workshops, workshop specials and parties for active members as well as non-members. These are referred to below as events.
(2)All participating persons are subject to the provisions of these conditions of participation. By participating or - in the case of events with registration - by registering, you agree to these terms and conditions. Participating persons are referred to below as participants.
 
§2 Registration
(1)Participation in events with registration is only permitted after prior registration and confirmation from the organizer. For events in the sense of a drop-in event, prior registration is not necessary; presence is sufficient here. A person who registers is hereinafter referred to as a registrant.
(2)Registration is done electronically using a registration form or, in exceptional cases, by email.
(3)The registrant will receive a confirmation of the registration via email (registration confirmation). The dispatch of these can be delayed due to technical reasons. A registration confirmation does not constitute a confirmation of participation in the event.
(4)Registration is always for one person. If, contrary to sentence 1, a separate regulation is made, this can be seen in the description of the event and in the registration form.
 
§3 Payment, acceptance of participation and invoice
(1)A registrant receives a payment request by email as soon as a place is available to participate in the event. This contains the payment details with details of the complete registration ID, the scope of registration, the organiser's bank details and the date on which the payment amount must have reached the organizer at the latest. The full registration ID must be given in the transfer.
(2)The registrant must pay the participation fee within a defined period of time or by a defined date. This information is contained in the email with the payment request. If the payment is not made accordingly, the organizer can give the reserved space to another registrant. Participation becomes binding upon payment.
(3)For presence drop-in events, the participation fee must be paid in cash at the venue before the start of the event. A bank transfer or cashless payment is not provided here. For online drop-in events, payment can only be made by bank transfer.
(4)As soon as the organizer has received the payment, he will inform the registrant and confirm participation by email (participation confirmation).
(5)Notwithstanding §3 (1) and (4), the organizer can also give a commitment if payment in cash at the venue for the event has been agreed with the registrant (e.g. in the case of a short-term confirmation to the registrant).
(6)Workshop specials are to be handled according to §3 (5). A payment obligation already exists from receipt of the confirmation of participation.
(7)An invoice for the participation fee for the event can be issued on request. To this end, the registrant must send a notification to the organizer after confirmation of participation (by email to workshops@swinginpoolcologne.de). In the case of presence drop-in events, the request for an invoice must be expressed when the participation fee is paid on site or, in the case of online drop-in events, promptly by email. The invoice will be issued in retrospect.
(8)Deviating from §3 (3), (4) and (5), a separate regulation can be made if the situation requires it. For this purpose, the correspondingly different procedure is listed at the event.
(9)If access to an online event is used by several people, each person is liable to pay. Separate regulations in accordance with §2 (4) are taken into account. If a person cannot be identified, the person taking part who enables access is liable to pay on their behalf.
 
§4 Informationen about the Event
(1)All information about an event will be published on the organizer's website. These are solely binding.
(2)In addition, information can be published as a Facebook event or on other platforms. However, these are not binding.
 
§5 Cancellation of participation by the participant
(1)There will be no reimbursement of the participation fee for workshop specials.
(2)The following rule applies to all other events, whereby the key date is the receipt of the participant's email by the organizer:
  • up to 1 month before the start, 50% of the participation fee will be reimbursed,
  • up to 14 days before the start, 20% of the participation fee will be reimbursed,
  • if the course is inclusive and less than 14 days before the start, there will be no reimbursement of the participation fee.
(3)If a participant can provide a substitute who can take over the booked space, this can be done by email after consulting the organizer. There is no processing fee. The participant and the substitute settle the cost of the participation fees between themselves, the organizer is not involved.
(4)If the organizer can provide a replacement (e.g. from the waiting list) who will take over the booked space, the participation fee minus a processing fee of € 20 can be reimbursed. If the participation fee is equal to or less than the processing fee, there will be no reimbursement.
(5)If a registrant has not yet received a request for payment (participant is still on the waiting list) or no payment has yet been made, the cancellation is generally free of charge.
 
§6 Cancellation of the event
(1)If the event is canceled due to force majeure, official orders or reasons for which the organizer is not responsible, the participant will be reimbursed at least 60% of the participation fee. The actual amount results from the costs already incurred by the organizer.
(2)The organizer cannot be held liable for any further costs incurred by the participant (e.g. travel and accommodation costs).
 
§7 Hygiene
(1)Every participant is obliged to counteract the spread of any disease.
(2)Individuals wishing to attend an event must not have a communicable disease at the time. This also includes, in particular, droplet infections (e.g. flu, flu-like infection, ...).
(3)If the organizer or a person appointed by him determines a person affected according to §7 (2), he is entitled to remove this person immediately from the event to protect other participants without reimbursement of the participation fee.
(4)Since illnesses always go hand in hand with an incubation period and therefore symptoms are not immediately recognizable, participants are encouraged to use the usual hygiene measures of the Robert Koch Institute (RKI) and the Federal Center for Health Education (BZgA). This includes in particular regular cleaning of the hands as well as coughing and sneezing in the crook of the arm.
(5)Participants should take care to avoid unpleasant smells, etc. counteract this by changing clothes regularly and using deodorants.
 
§8 Manners and security
(1)All participants behave respectfully towards others and do not judge anyone because of their origin, appearance, religion, gender or other characteristics.
(2)The rules of the organizer's code of conduct apply.
(3)If people are reported to the organizer who do not comply with these regulations, they can - after a conversation with the organizer or a person appointed by him - be expelled from the event immediately or after a warning. The participation fee will not be reimbursed.
(4)The organizer ensures that the event takes place in a safe and risk-free environment for everyone. If a dangerous situation arises during the event, the organizer is entitled to cancel the event. The participation fee will not be reimbursed.
(5)Each participant is fundamentally responsible for their own safety. The organizer cannot be held liable for injuries caused by the participant himself or by other participants.
 
§9 Image, sound and video recordings
(1)Recordings by participants during a face-to-face or online event are generally not permitted. Exceptions are recap recordings, which, however, must be approved by the respective instructor. These recordings may not be made available on publicly accessible platforms.
(2)Recordings made by the organizer or persons commissioned by the organizer can be published by the organizer for the purpose of documentation or advertising. This applies to the Internet, radio, television and print media (generally, however, the website and Facebook page of the organizer and the organizer's Facebook group). The participant explicitly agrees to this by participating in the event.
 
§10 Privacy
(1)Personal data that are collected during the event are subject to data protection and will only be used for the respective event.
(2)People who come into contact with personal data during the event are obliged to maintain confidentiality before, during and after the event.
(3)The organizer's Privacy Policy (german: "Datenschutzerklärung") applies in full.
